HitPoint Inc. creates games that are distributed on social networks, where players can share their stats, progress, and other facets of gameplay with their friends through social network messaging. HitPoint takes the privacy of a player’s personal details seriously. Please be assured that we handle your data with great care, and strictly abide by the laws of data protection.
Where applicable, before commencing gameplay, a user will consent to their personal data being recorded and used by HitPoint in the ways outlined in this document. The game’s functionality is contingent upon this data for communicating with players, and for allowing players to communicate with one another.
2. HitPoint Player and Game Data
When playing a HitPoint game, HitPoint uses a player’s data (e.g. player name, level, results, prizes, coins) to provide them with a unique gaming experience. This may also include information that HitPoint swaps with the platform on which you play our games (including but not limited to your profile name, profile picture, gender, networks, User ID, friends list, etc.). Our company is continually refining its games and services, adapting them to user requirements by using data provided anonymously or under a pseudonym. HitPoint positively encourages every player to make an active contribution to the design of our games and services. We use given personal data to manage game registration, to personalize subsequent visits, and to operate and stage our games.
Since the majority of HitPoint games also provide an opportunity for a communal gaming experience, HitPoint may also display your player status or scores to friends and/or other players. In addition to this and only if needed, HitPoint may request a user’s personal data for billing any games and services that have been used. HitPoint may also use personal data in locked form to comply with any retention periods mandated by law or required by contract.
If a user sends us an inquiry or subscribes to a special service (a newsletter, for instance), we will ask for any information needed to deal with the request. This information will be used on a voluntary basis and only to the extent required or previously approved by the User (see also Item 10).
HitPoint may appoint third parties to help us provide our services (such as for operating technical platforms or processing payments). However, we take responsibility for monitoring how your information is used at any time.
3. Email and other electronic addresses
Some of our games have the opportunity for the user (when registering for a game, for example) to provide their email or other electronic addresses so that we can share game news with them. This may be through, but is not limited to, Newsletters, Welcome Messages and Updates.
If you opt to do so, you may at any time remove yourself from our mailing list(s), and you can withdraw consent to receive future correspondence from us with immediate effect. The simplest way to do this is to use the special link or email function provided within the game or mailing, and specify your preferred settings.
4. Use of personal data for marketing purposes
We will never sell any user’s personal data to third parties, for marketing or other purposes.
If the player has given consent (see also Item 10), we may display targeted advertising within HitPoint games and services, or we may place or arrange for a cookie so that targeted advertising can be displayed within their browser. This may include advertising suggested to be of particular interest to that player in terms of the game being played, or the player’s age group or where they live. We mainly advertise our own games and services. If we ever advertise for a third party, we will not provide the advertiser with any personal data, and IP addresses will be duly abbreviated.
5. Use of personal data by other players on HitPoint networks
Depending on a user’s settings, other players may see personal data in the game or on the relevant platform (e.g. scores). We do not allow other players to use this information outside of a game. If another player obtains your personal data because of the way you have adjusted your privacy settings, HitPoint can no longer guarantee the protection of your information. For this reason, each player should personalize their settings to ensure that personal data can only be viewed by trusted people or those users specified by the player.
HitPoint’s games are offered through a variety of platforms (currently: Facebook.com, Wild Tangent, and Hi5). We reserve the right to offer our games through other platforms for apps and software as our needs dictate, with or without notice.
Any platform of this kind might collect and use personal details whenever a user accesses it, registers with it, or uses it. HitPoint has no control over this. Users will find data privacy policies and information relevant to privacy questions in the platform’s “Terms and Conditions,” its “Statements of Rights and Responsibilites,” or a similar User agreement.
7. Facebook plugins
HitPoint uses social plugins (such as the “like” button) from the social networking site Facebook.com. These plugins are operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins are identified by the use of registered Facebook logos (a white “f” on a blue tile or a “thumbs up” sign), or we have specially marked them as a “Facebook Social Plugin”. The list of Facebook Social Plugins and what they look like can be viewed on Facebook at http://developers.facebook.com/plugins.
If a player accesses a HitPoint website that contains one of these plugins, their Internet browser connects directly with the Facebook servers. Facebook sends the content of the plugins directly to that browser and back. Because our company has no control over the amount of data that Facebook collects with the help of these plugins, we would like to share our latest knowledge with you:
- Through these plugins, Facebook receives notification that the user has loaded the given page on our website. If you are logged into Facebook at the same time, Facebook can allocate the visit to your personal Facebook account. If you interact with the plugins, such as by pressing the “like” button or posting a comment, that information is immediately transmitted by the browser directly to Facebook, where it is saved. If you are not using Facebook, the service can still collect and store your IP address.
- If you’ve signed up to Facebook, but do not want Facebook to collect data via HitPoint’s website and link it up with the data stored on Facebook, you must log off Facebook before visiting a HitPoint website.
- If you do not belong to Facebook or have not yet granted consent to Facebook to having your data collected and used, we recommend not clicking on Facebook plugins.
- More information on how much data is collected and why, and how it is then processed and used by Facebook, as well as details about users’ rights and the settings available for protecting your privacy, can be obtained from Facebook’s data protection policy at www.facebook.com/policy.php.
8. Use of other plugins
Our games, services, and websites may also contain other plugins. Each plugin is the responsibility of its provider (e.g. Twitter, Google). Again, this means that HitPoint has no control over the amount of information the respective provider collects or how it uses that information.
If you are not yet a customer of the provider or have not yet consented to having your data collected and used, we recommend not clicking on these plugins.
If, on the other hand, your are already a customer of the plugin provider, you should refer directly to the relevant provider for information on the kind and amount of personal data it collects and uses, and for what purpose.
9. Information; deletion and blocking of data
You are always able to view your gaming details (e.g. player name, score, units, features) by logging in to the relevant platform and calling up the game. Users can make their own deletions and amendments there directly.
Upon request from a valid agent or agency and in accordance with law, HitPoint will immediately provide information free of charge on any user and inventory data – electronically or in writing. Before furnishing any information, we may insist on being sent some form of documentation to prove the inquirer’s identity and confirm the authenticity of the request.
Once a user’s contractual agreement with HitPoint has come to an end, essential data will be blocked for an appropriate processing period, and any optional information other than that may be erased.
10. Withdrawal of consent; objection to advertising, market research or opinion polls
While the use of personal data is based on consent given by the user, consent may be withdrawn at any time with immediate effect. Information on how to do this can be found in the FAQ on the relevant game.
Withdrawing consent may result in service cancellation or to the termination of your contractual agreement with our company. HitPoint reserves the right to base our data privacy procedures on statutory regulations at any time.
If a user wishes to object to its personal details being used for advertising, market research, or opinion polls, further information can be found in the FAQ on the relevant game. A notice or unsubscribe option (e.g. a button) may be provided on each service used. If a user sends an objection, advertising that does not use its personal data (InGame, for example) will not be affected.

We use standard security practices, including encryption, passwords, and physical security measures to protect your personal data from unauthorized access and disclosure. User account information is stored on a secure server with firewall protection. If a user enters sensitive data (such as a credit card number), we encrypt that information using secure socket layer technology (SSL).
